ACCEPTANCE OF THE TERMS
These Terms of Use (the “Terms”) constitute a binding legal agreement between Bayosell.com (referred to as “Bayosell,” “we,” “us,” or “Administrator”), and you, the user. By accessing or using the Bayosell platform (the “Platform”), including any related websites, applications, content, services, or tools provided by Bayosell (collectively, the “Service”), you agree to comply with and be bound by these Terms.
If you do not agree with any part of these Terms or if you are not authorized to agree to these Terms, you must not use the Service.
You are also required to review our Privacy Policy. The terms in the Privacy Policy and other supplemental terms, policies, or documents that may be posted on the Platform from time to time are incorporated into these Terms by reference. Bayosell reserves the right to modify these Terms at any time without prior notice. We encourage you to review these Terms periodically

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. We disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Bayosell does not control or guarantee the quality, safety, or legality of products or services posted by users. Users are responsible for ensuring that goods and services comply with applicable laws and regulations. Bayosell does not guarantee the ability of buyers to pay or sellers to complete transactions.
You are responsible for exercising due diligence when engaging with other users on the Platform. We recommend meeting in safe, public places when completing transactions.
ACCOUNT REGISTRATION
To access certain features of the Service, you may need to create an account on Bayosell.com (the “Account”). You may register as an individual or as a representative of a business entity.
By registering, you confirm that you are at least 18 years of age or have the consent of a parent or guardian if you are a minor. You agree to provide accurate, current, and complete information when registering and to update your information as necessary.
You are solely responsible for maintaining the confidentiality of your account information and for any activity that occurs through your account. If you suspect any unauthorized use of your account, you must immediately notify Bayosell. We are not liable for any losses resulting from your failure to comply with these requirements.
Bayosell reserves the right to suspend or terminate your Account at our discretion, for violations of these Terms.
THE SERVICE
Bayosell.com is an online platform that allows users to post and view announcements for goods and services. While Bayosell facilitates communication between buyers and sellers, we are not involved in the actual transactions. All agreements, sales, and service contracts are directly between the users of the Platform.
Users are solely responsible for handling taxes associated with the sale of goods and services, and Bayosell is not responsible for the collection or remittance of taxes.
Bayosell reserves the right to remove any listings that violate our policies or applicable laws. We may suspend access to the Service without prior notice for reasons including, but not limited to, legal requirements, intellectual property claims, or violations of these Terms.
FEES AND PAYMENTS
Bayosell is generally free to use, but some features may incur charges. We may set limits on posting in certain categories or offer promotional services for a fee. Fees will be clearly disclosed, and Bayosell reserves the right to change them at any time. Unless otherwise required by law, fees are non-refundable.

USER REPRESENTATIONS AND WARRANTIES
By using the Service, you represent and warrant that:
- You are legally capable of entering into agreements and agree to comply with these Terms.
- If you register as a business, you have authorization from the company to do so.
- You will provide accurate, current, and complete information in your Account.
- You will promptly notify Bayosell of any unauthorized access to your Account.
- You will comply with all applicable laws and regulations when using the Service.
You will not:
- Post false or misleading information.
- Engage in illegal activities, or post prohibited items.
- Violate the intellectual property rights of others.
- Use the Platform to distribute spam, viruses, or engage in any form of malicious activity.
- Post content that is discriminatory, abusive, harassing, or inappropriate.
INDEMNITY
You agree to indemnify and hold harmless Bayosell, its affiliates, officers, employees, agents, and other parties from any claim, demand, damages, losses, or expenses (including legal fees) arising from your use of the Service, your content, or any violation of these Terms.
LIMITATION OF LIABILITY
In no event will Bayosell be liable for any indirect, consequential, special, incidental, or punitive damages, or for any lost profits, arising out of your use or inability to use the Service, even if we have been advised of the possibility of such damages.
Our total liability to you shall not exceed the lesser of the amounts you paid to us for the use of the Service in the six (6) months prior to the event giving rise to the claim, or $100 (or the equivalent in local currency).
INTELLECTUAL PROPERTY RIGHTS
The content provided on Bayosell, including but not limited to text, graphics, images, logos, and software, is the property of Bayosell or its licensors and is protected by intellectual property laws. You may not use, copy, modify, or distribute any of these materials without prior consent from Bayosell.
By posting content on Bayosell, you grant Bayosell a non-exclusive, worldwide, royalty-free license to use, display, modify, and distribute your content in connection with the operation of the Service.
CLAIMS OF INTELLECTUAL PROPERTY VIOLATIONS
If you believe that your intellectual property rights have been infringed upon by content posted on Bayosell, please contact us with a detailed notice that includes the following:
- A description of the work you believe has been infringed.
- A description of the infringing content with enough detail to allow us to locate it on the Platform.
- Your contact information.
- A statement that you believe in good faith that the content is infringing your rights.

GOVERNING LAW AND DISPUTE RESOLUTION
These Terms shall be governed by the laws of [Jurisdiction], without regard to its conflict of laws principles. Any disputes that arise out of or in connection with these Terms will be resolved through binding arbitration under the rules of the [Arbitration Body].
MISCELLANEOUS
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
