Notice for Claims of Intellectual Property Violations and Copyright Infringement

Bayosell.com (the “Administrator”, “we”, “us”), including its affiliated companies, is committed to respecting intellectual property rights and expects users to do the same. This page outlines our procedures for addressing allegations of copyright and trademark infringement on the Bayosell platform and provides information on how to submit a claim.

Notification of Copyright Infringement

If you are a copyright owner (or an agent of a copyright owner) and believe that content posted by a user on Bayosell infringes upon your copyrights, you can submit a Notification of Copyright Infringement. To do so, please send a detailed notice that meets the following requirements to support@bayosell.com. If your notice does not meet the required criteria, it may not be valid

Your notice must include the following:

  1. Signature: A physical or electronic signature of a person authorized to act on behalf of the copyright owner whose rights are allegedly infringed.
  2. Infringing Material: A clear identification of the material you claim is infringing on your copyright, including sufficient information to locate the material on our platform (such as a URL or other reference).
  3. Copyrighted Work: A clear description of the copyrighted work that is being infringed. If multiple works are affected, you may submit a representative list of works on the website.
  4. Contact Information: A reasonably sufficient method for us to contact you, preferably an email address.
  5. Good Faith Statement: A statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
  6. Certification: A statement made under penalty of perjury confirming the accuracy of the information provided and that you are authorized to file the complaint on behalf of the copyright owner.

We recommend consulting your legal advisor before submitting a Notification of Copyright Infringement. You should be aware that submitting a false claim of copyright infringement may result in liability for damages.

Once we receive a valid Notification of Copyright Infringement, we will take the appropriate action at our discretion, which may include:

  • Removing or disabling access to the infringing material;
  • Notifying the content provider, member, or user that the material must be removed or access disabled;
  • Terminating the account of repeat offenders.

Notification of Trademark Infringement

If you are a trademark owner (or an agent of a trademark owner) and believe that any content posted on Bayosell infringes upon your trademark, you can submit a Notification of Trademark Infringement. Please send a notification meeting the following requirements to support@bayosell.com. Failure to comply with these requirements may render your notice invalid.

Your claim must include the following:

  1. Signature: A physical or electronic signature of a person authorized to act on behalf of the trademark owner whose rights are allegedly infringed.
  2. Infringing Material: A clear identification of the material you believe is infringing your trademark, with sufficient information to locate it on our platform (such as a URL or other reference).
  3. Trademark Ownership: A certificate of ownership for the trademark, including the full trademark name, registration number, applicable region, products/services related to the trademark, and the name and address of the trademark owner.
  4. Contact Information: A method of contacting you, preferably an email address.
  5. Good Faith Statement: A statement that you have a good faith belief that the use of the trademark is not authorized by the trademark owner, its agent, or by law.
  6. Certification: A statement made under penalty of perjury confirming the accuracy of the information provided and your authorization to file the complaint on behalf of the trademark owner.

Once a valid Notification of Trademark Infringement is received, Bayosell will take appropriate action at its discretion, including:

  • Removing or disabling access to the infringing material;
  • Notifying the content provider, member, or user that the material must be removed or access disabled;
  • Terminating the account of repeat offenders.

General Terms

Regardless of whether we terminate access or use of the platform by a user, Bayosell does not waive any rights to pursue legal remedies available under law or equity against copyright or trademark infringers or other intellectual property rights violators. We will not indemnify or provide legal representation to alleged infringers in any actions arising from their use of the Bayosell platform, except as explicitly described in this policy.
